DATA PRIVACY STATEMENT

 

We only process personal data (hereinafter mostly referred to simply as “data”) within the scope of necessity and for the purpose of providing a functioning and user-friendly website, including its content and the services offered on it.

According to Art. 4(1) of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to simply as "GDPR"), "processing" means any operation or set of operations which is performed in connection with personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or other form of provision, alignment or combination, restriction, erasure or destruction.

With the following data privacy statement we particularly inform you about the type, extent, purpose, duration and legal basis of the processing of personal data to the extent that we decide on the purpose and means of the processing either alone or together with others. We also inform you below of the third-party components we use for the purpose of optimisation and to increase the quality of use, insofar as third parties process data on their own responsibility as a result.

II. RIGHTS OF THE USERS AND PARTIES CONCERNED

With respect to the data processing described in more detail below, the users and parties concerned have a right to the following:

  • confirmation as to whether data concerning them is processed, information about the data processed, further information regarding the processing of data, and copies of the data (see Art. 15 GDPR);
  • rectification or completion of incorrect or incomplete data (see Art. 16 GDPR);
  • immediate erasure of the data concerning them (see Art. 17 GDPR), or alternatively, if further processing according to Art. 17(3) GDPR is necessary, restriction of processing in accordance with Art. 18 GDPR;
  • receipt of the data concerning them and which they have provided, and the transmission of this data to other providers/controllers (see Art. 20 GDPR):
  • lodge a complaint with the supervisory authority if they consider the data related to them to be processed by the provider such that this infringes data protection regulations (see Art. 77 GDPR).

The provider is furthermore obliged to notify all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or the restriction of processing which occurs based on Articles 16, 17(1) or 18 GDPR. This obligation does not, however, exist if this notification is impossible or it involves a disproportionate amount of effort or expense. Regardless of this fact, the user has a right to information about these recipients.

The users and parties concerned likewise have a right to object to the future processing of the data relating to them according to Art. 21 GDPR if the data is processed by the provider in accordance with Art. 6(1) lit. f) GDPR. Objections against the processing of data for the purpose of direct advertising in particular are admissible.

III. INFORMATION ON DATA PROCESSING

The data related to you that is processed when you use our website is erased or blocked as soon as the purpose for storage no longer applies, there are no legal retention obligations barring the erasure of the data, and no contrary information on individual processing procedures is subsequently given.

Cookies

a) Session cookies

We use cookies on our website. Cookies are small text files or other storage technologies which are filed and stored on your end device by the Internet browser you use. These cookies are used to process certain information about you to an individual extent, such as your browser or location data, or your IP address.  

Our website becomes more user-friendly, effective and secure due to this processing, as the processing enables our website to be played back in different languages or to provide a shopping cart function, for example.

The legal basis for this processing is Art. 6(1) lit. b) GDPR if this cookies data is processed to initiate or conclude a contract.

If the processing does not serve the initiation or conclusion of a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6(1) lit. f) GDPR

These session cookies are erased when you close your Internet browser.

b) Third-party cookies

On our website, cookies from partner companies we work together with for the purposes of advertising, analysis or the functionalities of our website may also be used if need be.

Please see the following information for details in this regard, particularly concerning the purposes and legal basis of third-party cookies of this kind.

c) Possibility of removal

You can prevent or limit the installation of cookies with a setting on your Internet browser. You can likewise erase cookies that have already been stored at any time. However, the steps and measures necessary to do this depend on the Internet browser you actually use. If you have any questions, therefore, please use the help function or documentation on your Internet browser or contact the manufacturer or support service. The processing of Flash cookies cannot, however, be prevented using the browser settings.  Instead, you will have to change the settings on your Flash player in this regard. The steps and measures necessary to do this also depend on the Flash player you actually use. Likewise, therefore, if you have any questions, please use the help function or documentation on your Flash player or contact the manufacturer or user support.

If you should prevent or limit the installation of cookies, however, this may result in not all of the functions on our website being able to be used to the full extent. 

Contact requests / Contact options

If you contact us by contact form or email, the data you enter will be used to process your request. The data entry is necessary for us to process and reply to your request – if the data is not provided, we will not able to reply to your request at all, or at best to a limited extent.

The legal basis for this processing is Art. 6(1) lit. b) GDPR.

Your data is erased provided that your request has been answered conclusively and there are no legal retention obligations barring its erasure, such as the possible subsequent conclusion of a contract.

Google Maps

We use Google Maps on our website to display our location and to create directions for how to get to us.  This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA,, hereinafter referred to simply as “Google”.

Google guarantees that the EU data protection provisions will also be observed in the processing of data in the USA.

To enable certain fonts to be shown on our website, a connection is set up to the Google server in the USA when our website is accessed.

If you access Google Maps, which is an integrated component on our website, Google stores a cookie on your end device via your Internet browser. Your user settings and user data are processed so that our location can be shown and directions for how to get to us can be created. We cannot exclude the possibility that Google will use servers in the USA in this regard.

The legal basis is Art. 6(1) lit. f) GDPR. Our legitimate interest lies in optimising the functionality of our website.

With the connection to Google that is established in this way, Google can identify which website your request was sent from and which IP address the directions are to be transmitted to.

If you do not agree to this processing, you have the option of preventing the cookies from being installed by selecting the corresponding settings on your Internet browser. Details of this are to be found above under “Cookies”.

YouTube

We use YouTube on our website. Here it concerns a video portal belonging to YouTube LLC., 901 Cherry Ave., 94066 San Bruno, CA, USA, hereinafter referred to simply as “YouTube”.

YouTube is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to simply as “Google”.

Google, and therefore its subsidiary YouTube as well, guarantee that the EU data protection provisions will also be observed in the processing of data in the USA.

We use YouTube in connection with the “extended data protection mode” function to be able to show you videos. The legal basis is Art. 6(1) lit. f) GDPR. Our legitimate interest lies in improving the quality of our website. According to the information provided by YouTube, in the “extended data protection mode” function the data described in more detail below will only be transferred to the YouTube servers if you actually start to play the video.

Without this “extended data protection”, a connection is set up to the YouTube servers in the USA as soon as you access one of our web pages containing an embedded YouTube video.

This connection is necessary to be able to display the respective video on our website via your Internet browser. In the course of this, YouTube will gather and process at least your IP address, the date along with the time, and the website you have visited. In addition, a connection will be set up to Google’s advertising network “DoubleClick”.

If you are logged into YouTube at the same time, YouTube assigns the connection details to your YouTube account. If you wish to prevent this, you either have to log out of YouTube before visiting our website or select the appropriate settings in your YouTube user account.

For the purpose of functionality, and to analyse user behaviour, YouTube stores cookies permanently on your end device via your Internet browser. If you do not agree to this processing, you have the option of preventing the cookies from being stored by selecting a setting on your Internet browser. Online job applications / Announcement of job advertisements

We offer you the possibility of applying to us via our website. In these digital applications, we collect and process your application data to carry out the application procedure.

The legal basis for this processing is section 26(1) 1st sentence Federal Data Protection Act (BDSG) in conjunction with Art. 88(1) GDPR.

If an employment contract is concluded after the application procedure, we store the data you transmitted in your application in your personnel file for the purpose of the general organisation and administration process – with due regard to the further legal obligations.

The legal basis for this processing is likewise section 26(1) 1st sentence Federal Data Protection Act (BDSG) in conjunction with Art. 88(1) GDPR.

If an application is rejected, we automatically erase the data sent to us two months after the rejection has been announced. If statutory regulations such as the obligation to provide proof according to the Equality Act (AGG), for example, require the data to be stored for a longer period of up to four months or until a court procedure has been completed, it is not erased, however.

In this case the legal basis is Art. 6(1) lit. f) GDPR and section 24(1) no. 2 Federal Data Protection Act. Our legitimate interest lies in legal defence and the enforcement of the law.

If you expressly consent to your data being stored for a longer period, for instance so that you can be included in a database of applicants or interested parties, the data will be processed further based on your consent. The legal basis is then Art. 6(1) lit. a) GDPR. You can of course withdraw your consent at any time according to Art. 7(3) GDPR by submitting a declaration to us with future effect.
